Become Unmistakable, LLC (hereinafter sometimes referred to as “BUL”) is sensitive to privacy issues on the Internet and is committed to transparency in its data processing and privacy efforts. We believe it is important that you understand how we treat the information you may provide to us or which we may otherwise collect and hold in the course of providing our services. This privacy statement applies to information collected by, and sites and domains owned and operated by, Become Unmistakable, LLC (hereafter referred to collectively as “BUL” or “we” or “us”) in connection with BUL’s uMap™ products and services, including, but not limited to, https://myumap.wpcomstaging.com/. Information We Gather and the Basis for Gathering
In the normal course of business, we will collect both information that is personally identifiable to you (“Personal Information”) and non-personal information associated with you. Our collection and processing of your Personal Information will be upon your consent (for information you choose to provide); to take steps in connection with any request you may have made in advance of entering into a contract with us or in connection with the performance of any contract you may enter into in connection with us; and in furtherance of BUL’s legitimate interests. In particular, we collect (a) information you provide to us which is personally identifiable to you such as name, e-mail address, telephone number, address and other personally identifiable information you submit to us including information about yourself and your goals as part of completing your uMap™ brand tool and/or as part of our uMap™ brand services, (b) information which we automatically gather which may be about you or relate to your visit to or use of the site but which is not personally identifiable to you. Notice will be provided in the event BUL uses or discloses the personally identifiable information for a purpose other than for which it was originally collected. In the event BUL will disclose the personally identifiable information for a purpose other than the purpose for which it was originally collected or authorized under this Privacy Policy or as subsequently authorized by the individual, BUL will offer individuals the opportunity to opt out of such disclosure.

How we Gather Information
Normal course of business:
When you contact BUL, we may keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements. We also collect information you submit to us including information about yourself and your goals as part of completing your uMap™ brand tool and/or as part of our uMap™ brand services.

Website Activity
Log Files
As is true of most web sites, we gather certain information automatically and store it in log files. This information may include IP addresses, browser type, referring/exit pages, operating system, date/time stamp, and clickstream data. We may collect device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number). BUL may associate your device identifiers or phone number with your BUL Account. We use this information to analyze trends, to administer the site, and to track how visitors interact with the site.

Cookies
A cookie is a small file that is stored on a user’s computer for record-keeping purposes. BUL typically uses both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our site. A session cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time, and can be used when you return to our site to help identify you or allow you to log in, or on other third-party sites to communicate to you via online-marketing channels. You can remove persistent cookies by following directions provided in your Internet browser’s help file. If you reject cookies, you may still use our site, but your ability to use some areas of our site will be limited and you may need to reenter personal information when you register.

Your Choice as to Whether or Not We Gather Information
The submission or collection of Personal Information is voluntary. If you do not wish us to collect Personal Information, do not submit it to us and follow the instructions to reject cookies.

How We Use and Disclose Your Information
Information you provide (or which we gather) about you or your goals for inclusion in your uMap™ brand tool or as part of our uMap™ brand services may be shared with your organization and others within your organization based upon the choices made by your organization or its designated account administrator. BUL further reserves the right to use and disclose information you provide (or which we gather) about you or your goals on an aggregate or non-personally identifiable basis. Except as set forth above, we will always endeavor to protect this information and, where appropriate, hold it in confidence, and protect it from theft. In general, we utilize both non-personal and personally identifiable information that you provide to us or that we collect in the normal course of business to communicate with you about our service and product offerings and deliver those offerings in an efficient manner. For these purposes, BUL employees or authorized contractors and third-party agents will have access to some or all of this identifiable information. In addition, we use and disclose your information as follows: to send occasional newsletters to you (unless you opt out of receiving them) and, if you choose to have a “personal icon” as part of the uMap™ brand report created by us on your behalf, to a third party graphic designer who may be engaged to create the personal icon (in which case, the third party graphic designer will have agreed to be bound by the terms of this Privacy Policy).

Legal Access to Your Information
We may share personal information with companies, organizations or individuals outside of BUL if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

  • meet any applicable law, regulation, legal process, subpoena or enforceable governmental request.
  • enforce applicable Terms of Service, Terms of Use, or other potential violation of BUL contracts or rules, including investigation of potential violations.
  • detect, prevent, investigate or otherwise address fraud, security or technical issues.
  • protect against harm to the rights, property or safety of BUL, our users or the public as required or permitted by law.

Transparency and Choices You Have About How We Use and Disclose Your Personal Information
If you do not wish us to collect Personal Information, do not submit it to us and follow the instructions to reject cookies when using the site.

How we Protect Your Personal Information
BUL’s data security is described in this Privacy Policy and includes reasonable steps to protect your Personal Information from loss, misuse and unauthorized access, disclosure, alteration, and destruction. BUL has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure Personal Information from loss, misuse, unauthorized access or disclosure, alteration, or destruction. No system can ensure complete security of all information and you acknowledge that risk through use of the Site. Although BUL safeguards the security of the data you send us with physical, electronic, administrative and managerial procedures, we also urge you to take every precaution to protect your personal data when you are on the Internet. These precautions include not storing passwords, changing your password often, using a combination of letters, numbers and symbols, using two-factor authentication when available, and using a secure browser over a secured network.

BUL may employ independent contractors to help manage data services, and such contractors may have access to data, similar to the access we give our employees. We endeavor to ensure that these third-party providers are protecting your information, but we are not ultimately responsible for their practices.

Data Retention
BUL will retain your Personal Data only for so long as necessary to fulfill the purposes outlined in this policy or the purposes of which you have been informed. We will retain your Personal Data for as long as permitted under applicable legal grounds, after which it will be deleted. If our legal grounds for holding and processing your Personal Data rely on your consent (and no other legal grounds), and you have exercised your right to revoke your consent, we may be required to keep your Personal Data for a defined period in order for us to meet our legal obligations and defend ourselves in legal disputes under certain circumstances.

Data Integrity and Purpose Limitation
BUL shall only collect and use Personal Information in a way that is compatible with and relevant for the purpose for which it was collected or authorized by the individual.

Access and Corrections to Your Personal Information
If your Personal Information is being held and/or processed by BUL based on your consent (and no other basis) you may withdraw your consent. In relation to your Personal Data, you may request to (a) access your Personal Data, (b) rectify your Personal Data, (c) erase your Personal Data, (d) restrict the processing of your Personal Data, (e) object to the processing of your Personal Data and (f) withdraw your consent to the processing of your Personal Data. All requests must be in writing, signed by you, and set forth e-mail address or other information sufficient to establish your identity. To make such a request, please contact: support@myumap.com. Where permitted by applicable law, an administrative fee may be charged for administering such requests. All valid requests will be addressed in a prompt and proper manner and we will respond within thirty (30) days. If your request is denied, you may file a complaint to the local data protection authorities in the relevant governing jurisdiction. Please email support@myumap.com to review and update your personal contact information.

When BUL acts as a service provider or data processor rather than the business with control over the use of the Personal Information, BUL may refer such requests to the business having control over the use of the Personal Information rather than processing your request itself.

Links to Other Sites
The BUL website normally will not contain links to other sites that are not owned or controlled by BUL, but in the event that such links are provided, please be aware that BUL is not responsible for the privacy or security practices of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every web site that collects personally identifiable information.

Information Obtained from Third Parties
BUL does not sell or trade your personally identifiable information. We may at times receive contact lists from other organizations. We may send mailings such as brochures to these addresses. If you want to remove yourself from the third party’s database, you must contact them directly.

Statement Regarding Restrictions on Use
While BUL endeavors to maintain appropriate security controls to protect private data, viruses and hacking attacks cannot be entirely prevented. This site is not intended for persons under the age of 18.
BUL is based in the United States. If you choose to use those BUL Sites from the European Union, Canada or other regions of the world with laws governing data collection and use that may differ from United States laws, then please note that your Personal Information may be outside of those regions to the United States or other location for storage and processing. Also, we may transfer your data from the United States or from your location to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Site. By providing any information, including Personal Information, through the Site, you consent to such transfer, storage, and processing. The BUL websites may contain links to sites of BUL companies based outside the United States and the processing, storage and transfer of information submitted to or collected by those sites may be governed by the laws of their respective jurisdictions.

Recourse, Enforcement and Liability
BUL uses a self-assessment approach to assure compliance with this Privacy Policy and periodically verifies that the Privacy Policy is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented and accessible, and in conformity with applicable standards.
When we receive formal written complaints about our compliance with our privacy policies we will contact the person who made the complaint to follow up. We work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that we cannot resolve directly. BUL may further refer unresolved privacy complaints under the Privacy Policy for alternative dispute resolution to the Council of Better Business Bureaus or other third party neutral. Please note that if you are a European Union individual and your complaint is not resolved through these channels, under certain circumstances, a binding arbitration option may be available.
We ask that you not send to us any sensitive Personal Information such as Social Security numbers, information related to ethnic origin or race, political affiliation religion, personal health, criminal background, sexual orientation, sexual history or trade union membership.

Changes to this Privacy Statement
We reserve the right to modify this privacy statement at any time, so please review it frequently. If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. This Privacy Notice is issued by Become Unmistakable, LLC (collectively referred to as “BUL”, “we”, “us” and “our” in this Privacy Notice).

This Privacy Notice for California Residents supplements the information contained in BUL’s general privacy notice available at myumap.com and applies only to personal information (defined below) concerning individuals who reside in the State of California (“consumers” or “you”) in connection with their visit to our website or our services, products, and applications offered by BUL (“Services”). We provide this notice in accordance with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this Notice.

Notice Regarding Collection, Use, Disclosure, and Sales of Personal Information
Our processing of your Personal Information, as set forth below, will vary based on the purposes for which it was collected, including, but not limited to, whether BUL collects such Personal Information for educational purposes only pursuant to an agreement with a school district or educational entity (“School”). Where the following data processing occurs in connection with our agreement(s) with a School, our processing of Personal Information and your rights with respect thereto will be in compliance with applicable federal and state law, as further described in BUL’s Privacy Policy for Student uMap Users and the relevant agreement(s) between BUL and the relevant School.

Information We Collect
We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, or household (“personal information“). Personal information does not include:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information excluded from the CCPA’s scope, like:
  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;

For example, if you share your name and contact information to request information or ask a question about our Services, we will use that personal information to respond to your inquiry.   • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
  • To personalize your website experience and to deliver content and Services relevant to your interests.
  • To help maintain the safety, security, and integrity of our website, products and Services, databases and other technology assets, and business.
  • For testing, research, analysis, and product development, which includes developing and improving our Services.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice and, when required by law, your consent.

Sharing Personal Information
When permissible under applicable law, we may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

Your Rights and Choices

Access to Specific Information and Data Portability Rights
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).

Deletion Request Rights
You have the right to request that we delete any of your personal information that we have collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

‍Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent, please contact us through the methods noted above. Only the consumer or authorized agent may make a verifiable consumer request related to their personal information. An “authorized agent” is a person (or a business entity registered with the California Secretary of State) that consumers have authorized to act on their behalf or an individual granted authority under a written power of attorney issued pursuant to California Probate Code sections 4000 to 4465.

If you are an authorized agent who wishes to submit a request to know, a request to delete, or a request to opt-out on behalf of another consumer, please submit to us sufficient information to allow us to verify your identity to a reasonably high degree of certainty and either:

  • Proof of authorization to submit the request, written and signed by the consumer; or
  • A power of attorney pursuant to Probate Code sections 4000 to 4465.
  • We may deny a request from an authorized agent who does not submit adequate proof that they have been authorized by the consumer to act on the consumer’s behalf. We may also contact the consumer directly to confirm their identity and that they provided you permission to submit the request on the consumer’s behalf.
  • You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.
We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

California’s “Do Not Track” Notice; Third Party Behavioral Tracking
“Do Not Track” (“DNT”) is a preference you can set in your web browser to let the sites you visit know that you do not want them collecting information about you. We are strongly committed to not sharing personal information with third parties without notice; under this Privacy Policy, we may share your information only under particular situations, as described herein. “Shine The Light” Law
California residents that have an established business relationship with us have rights to know how their information is disclosed to third parties for their direct marketing purposes under California’s “Shine the Light” law (Civ. Code § 1798.83) Under the “Shine the Light” law, California residents who provide certain personal information in connection with obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year.
Such requests must be submitted to us by contacting us in accordance with the “Contact Us” section in our Privacy Policy and specifying that you want a copy of your “Shine the Light” California Privacy Rights Notice. We will provide the requested information to you at your email address in response. Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response.

Changes to Our Privacy Notice
We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on our website and update the notice’s effective date. Your continued use of our website or any products, Services, or solutions following the posting of changes constitutes your acceptance of such changes.

This supplemental privacy notice (“Privacy Notice”) provides European Economic Area (“EEA”) individuals additional information required by the EU General Data Protection Regulation.
